1. Agreement to Terms
By accessing or using the services provided by DispatchInflow, operated by Big Things In Life LLC, you agree to be bound by these Terms of Service. If you do not agree with all of these terms, you are expressly prohibited from using the site and services.
2. Services Provided
DispatchInflow provides custom web development (via Framer) and automated AI telephony infrastructure. Service specifics, features, and monthly minute limits are dictated by the pricing tier selected at checkout (e.g., Modern Digital Front, 24/7 AI Voice Reception, or The Complete Engine).
3. Pilot Programs and Billing
14-Day Pilot: Qualifying local partners may receive a 14-day free pilot of the AI Voice Receptionist. If the service is not canceled before the end of the 14-day period, the agreed-upon monthly subscription rate will automatically be billed to the payment method on file.
Fees & Subscriptions: Setup fees are one-time and non-refundable unless explicitly waived in writing. Monthly subscriptions are billed in advance. Overages on call minutes beyond your tier’s allotment will be billed at standard overage rates.
4. Client Responsibilities & Compliance
Accuracy of Information: You are responsible for providing accurate business information, pricing, and policies for us to train the AI agent.
Telecommunications Compliance: As the end-user of the AI voice and SMS follow-up tools, you agree to comply with all applicable local, state, and federal laws, including the Telephone Consumer Protection Act (TCPA). You must ensure that you have the appropriate consent to send SMS text messages to your callers.
5. Intellectual Property Rights
Big Things In Life LLC retains all proprietary rights, title, and interest in and to the DispatchInflow platform, custom AI prompts, telephony workflows, and base website architectures. Clients retain all rights to their specific brand assets, logos, and proprietary business data provided to us.
6. Limitation of Liability
To the maximum extent permitted by law, Big Things In Life LLC and DispatchInflow shall not be liable for any indirect, consequential, incidental, or punitive damages, including lost profits or lost revenue arising from missed calls, software downtime, AI hallucination/misinformation, or telecom carrier outages. Our total liability shall not exceed the amount you paid us in the past three (3) months.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.
